PRELIMINARY DRAFT AND BILL OF REFORM OF CIVIL AND COMMERCIAL CODE AND ACT 26.944 OF STATE LIABILITY (ENACTED 8TH OF AUGUST, 2014). CONTRIBUTIONS, CONSIDERATIONS AND CRITICS THROUGH A CONSTITUTIONAL SCOPE
This paper deals with tort liability of the State in Argentine law. Firstly, its development in the Supreme Court of Argentina case law is analyzed. Secondly, Preliminary Draft and Bill of Reform of Civil and Commercial Code and Act 26.944 of State Liability (enacted 8th of August, 2014) are examined and criticized. Finally, the subject is discussed from a constitutional perspective – federalism and division of competences, equality before the law and inviolability of property.
