» HOW TO BE PRIOR THE PRIOR CONSULTATION?

Sumary

The activity developed by the international bodies in charge of interpreting and applying international instruments on human rights gave birth to a thorough case-law concerning the protection of indigenous peoples rights, and one of those rights refers to their colective right to their lands. This legal institute imposes on States the obligation to carry out a prior consultation with indigenous peoples in relation to public or private projects whenever they may affect their ancestral lands. In this article we will analize the content of the right of indigenous communities to prior consultation and the evolution of the international case-law in order to arrive to conclusions that clarify its scope.
