» THE AUDIOVISUAL COMMUNICATION SERVICES ACT: ONE VIEW THROUGH THE THEORY OF JÜRGEN HABERMAS

Sumary

The paper develops an analysis of the creation process of the Audiovisual Communication Services Act in Argentina. The analysis focuses on the theory of Jürgen Habermas, primarily in the role attributed to public space in non-institutionalized political democracy. The theoretical budget covers by the work, attempts to show that the creation and enactment of the Audiovisual Communication Services Act is an exercise in deliberative democracy in the terms in which Habermas define that concept. For this purpose in the paper we make a tour through the author s work, mainly on the concepts of public and non-institutionalized political public space. Then we describe the process of creation and sanction of act. In conclusion, it highlights the key role played by the civil society organizations in the process of creation as well as the possibilities for democratization of Argentine political system that this new act creates
