Sumary

This paper tries to assess, from the autopoietic, selfreferential and operationally closed systems theory, developed by Niklas Luhmann, which use gives the jurist Günther Jakobs to some concepts supposedly taken from Luhmann’s theory. Categories like society, communication, person, identity, subject or norm, are utilized in a heterodox way by the German jurist. As a result, it is necessary an observation of the concepts in and from the context of the autopoietic systems theory, so as to evaluate if the Jakob s proposal can be supported. The hypothesis of this paper is that Jakob’s choices drift into a completely different theory of society.
