» SELECTIVITY AS A NECESSARY MECHANISM FOR THE SUBSISTENCE AND CONSENSUS OF FREE MARKET

Sumary

The purpose of this worksheet is to evidence that selectivity is not only the criminalization processes of the criminal justice system owns result, but that it also plays a specific roll for the survival and development of capitalism as the most suitable tool for it’s punitive defense or consensual support. To arrive to this affirmation there will be a genealogical study of criminal selectivity in Argentina which will show that in the historical contexts where the socio-economic system is threatened, the repressive state apparatus’ discriminatory operation tends to intensify. Finally once developed this relationship it will be evaluated if selectivity has in the present a specific intentionality which emerges beyond the proper functioning of the criminal system.
