This paper is aimed at de-naturalizing the view of criminal proceedings involving crimes against
humanity, reopened in Argentina. The perspective from the ethnographic point of view applied to
oral debates carried out from year 2006 to date, allows the visualization of the staging of a
ritual linked to democracy. In this manner, aspects involving the ‘public policy’ in terms of
justice and human rights may be observed, applied to remedy violence inflicted by Government in the
past and to comply with international duties. All of the prior, leads to tension and disputes
between Government and society within the frame of the so called ‘fight against impunity’. Indeed,
criminal proceedings suppose an impact in ‘collective memory’ and therefore, it is possible to talk
about ‘juridical memory’. |
