» GENDER ISSUES AND ACCESS TO JUSTICE AS A HUMAN RIGHTS

Sumary

In Human Rights field, we can distinguish three hierarchical levels for cultural variation: human rights substance, the interpretation of human rights and the implementation of them and in these three elements is very important the gender vision to be possible the application of article 1 of CEDAW. The variability of human nature, compel to development in the human rights field, flexibility to the cultural relativism. But if we can admit that every right depend of culture and the roles that it is accepted by it, and then it could be questioned the existence of human rights, and these rights belongs to humans, because of their nature.
