» THE ARGENTINIAN STATE AND THE NATIVE PEOPLE. THE RESPECT FOR COMMUNITY S PROPERTY

Sumary

In the year 1994, the argentinian constitution was reformed, giving constitutional rank to the International Instruments that were about human rights. This radical change turned the eyes into a new politics oriented to the human rights, never the less this isn t the same all around the country, because the native people are devoid of their lands, that are necesary to continue with their culture. This property right ist what we ll analyze y who the national judges understand it; and if the articule 75. 17 in possible to be aply. As well we ll analyze the relation of the native people with their lands and see if wee can find any alternative way to make the state respect their rights.
