» THE RIGHT OF COLLECTIVE PROPERTY OF INDIGENOUS LANDS IN VENEZUELA: SCOPE, REALITY AND EXPECTATIONS

Sumary

In Venezuela, territorial indigenous issues are analyzed from a human rights point of view. Starting from the fact that collective property rights are been recognized by the 1999 Constitution and the State Declarations confirming their multicultural and pluriethnic nature. First, this article will review previous works analyzing this right in the Venezuelan legislation. The second part will investigate basic and specific concepts in which this right has been established as fundamental human right and as a base for the existence of original people within a state-nation. Finally, we shall look at the need for the real implementation of the same right going beyond mere political rhetoric. The importance of granting community land titles according to legal parameters is a constitutional postulate according to which rules a need to be essentially fair.
