» APPROACHES TO CONSTITUTIONAL ANALYSIS THROUGH LOCAL CONSTITUTIONAL LAW AND FEDERAL CONSTITUTIONAL LAW ABOUT JUDICIAL REVIEW

Sumary

This paper refers to Federalism y Republicanism. It is a comparison between Federal Constitutional Law and Six Local Constitutional Law about de Judicial Review. The Bassic Theory has been taken from the writings of Maximiliano Torricelli “El sistema del Control Constitucional Argentino” published Lexis Nexis 2002.
Three qualifications must be noted: the written form, the judicial review as action and general judicial effects as a law instead of the treatment as “case”. These are the characteristics make difference between federal and local constitutional law.
This conventional election introduces a pressure that makes a better Republicanism because the exercise of power control trough checks and balances avoids tyranny.
