Sumary
In the first part of this work, we intend to analyze the concept of responsible judicial activism,
in a serial of damages cases, where the judges decided to take some measures, generating creativity
sentences, and a mayor leadership of the tribunal. In the second part, we study the judicial
activism, from the point of view of the lawyer, in order to prove the hypothesis that they consider
judicial activism as a way to improve the service of justice, we will culminate with the
formulation of some conclusions, by way of proposals that only aspire to take to the reflection. |
