» BODY AND CAPITAL. POLITICAL ANATOMY OF HUMAN RIGHTS PROCEDURAL LAW

Sumary

This work aims at a genealogical study of connexions between capitalism and human rights taking into account one of the paradigmatic legal institutions of modern procedural law: the habeas corpus action.
In order to achieve that purpose, we will try to set the possible solidarities between this emblematic figure of roman procedural law and the consolidation of the civilized capitalistic machine throughout an historic-philosophic pathway of habeas corpus legal evolution in the jurisprudence and legislation, until arrive at the most complex figure of legal protection.
We will focus on the regulations that this procedural institute has obtained in the Argentinean Legal Order, assuming for the former that it constitute a minimal model of the central features of the Modern Western Law.
