Abstract

The research project that we propose follows the socio-normative approach, already used in our previous investigations where the different articulations of family law with social reality have been analyzed.In this case, we focus upon senior citizens in family relationships. Even though in the contemporary world special attention is dedicated to attend to the specific problems of seniors, this concern has not had all the desired impact in the Law, particularly, Family Law.One point of interest is the idea that discrimination affects individuals’ rights and leads to social marginalization.. At the same time, we shall study the different tools of inverse discrimination expressed in the form of affirmative action by the State to improve senior citizens’ quality of life.Our aim is to determine the effectiveness of affirmative action and specially analyze if and how it works within family relationships. Our final goal is to find a normative model as well as the social policies required in order to preserve senior citizens’ rights within the family which are intimately related to social integration.In this way we will address the right to care at the same time we approach a legal point of view of the intersection between senior citizens’ situation and mental illness. In the same way, and always related to senior citizens, we will analyze the support legal regime, the various problems that affect their personal autonomy, and the domestic violence they sometimes suffer. The relationship between grandparents and children, its positive effects and the different conflicts that obstruct communication between them. In short, the overall aim of this research is to develop the various aspects, conflicts, topics, and arguments that arise within Family Law with regards to families’ responsibilities towards senior citizens and identify the necessary adjustments in order to ensure their human rights. So as to achieve this it is necessary to allocate different duties between the State and the entire society.
